1. Overview
This website, zillabeau.com (the Site), is operated by Zillabeau, 26 W Forest Ave, Englewood, NJ 07631, United States (Zillabeau, we, us or our). These Terms of Service (Terms) apply to everyone who visits the Site, creates an account, joins a membership or program, or buys from us. By using the Site or placing an order, you agree to these Terms and to the policies they refer to, including our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use the Site.
2. Accounts
You must be at least the age of majority where you live to place an order. When you create an account, give us accurate information and keep it up to date. You are responsible for keeping your login secure and for activity under your account. Tell us right away at zilla@zillabeau.com if you think your account has been used without your permission.
3. Professional nail products
Many of our products, including gels, lamps, drills and tools, are made for professional nail services. Read and follow the manufacturer's instructions, warnings and curing times for every product. Perform a patch test when appropriate and stop using a product if irritation occurs. Some products, kits and programs are offered only to licensed professionals or registered students, and we may ask for proof before selling or activating them. Zillabeau is not responsible for results or injuries caused by misuse, incorrect curing, or use against the instructions.
4. Product information and colors
We work to show products, colors and descriptions accurately. Colors can look different depending on your screen, lighting and application, so we cannot guarantee that what you see on your screen matches the finished nail exactly. If we find an error in a description, image or specification, we will correct it.
5. Prices, orders and payment
- Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Taxes and shipping are calculated at checkout.
- Your order is an offer to buy. We may accept, limit or cancel any order, including orders with a pricing or listing error, orders that look fraudulent, or quantities that exceed reasonable personal or salon use. If we cancel an order you have paid for, we will refund the payment.
- Payments are processed at checkout through Shopify and its payment partners. You confirm that you are authorized to use the payment method you provide.
- Pre-order items ship when they arrive. If your order includes pre-order items, the whole order ships together once every item is ready, as described in our Shipping Policy.
6. Shipping, returns and refunds
Shipping, delivery issues, returns, restocking fees and refunds are covered by our Shipping Policy, Refund Policy and Shipping & Returns page, which form part of these Terms.
7. Memberships and recurring charges
Zilla+ is a recurring membership. When you join, you authorize us to charge your payment method at the frequency shown (monthly or yearly) until you cancel. You can skip or cancel from your account at any time; cancellation stops future charges. Member benefits, codes and shipping perks are described on the Zilla+ page and may change; we will post changes there. Member codes are for the member's own orders and may not be shared, resold or published.
8. Discount codes, rewards, promotions and games
- Discount codes have no cash value, apply only to eligible products, cannot be combined unless stated, and may be limited to one use or to certain customers. We may cancel codes or orders that use codes that were shared, resold or obtained against these Terms.
- Zilla Pro pricing and codes are available only to approved licensed professionals after verification.
- Reward points have no cash value, cannot be transferred, and are governed by the rules shown in the rewards program. We may change or end the program.
- Promotions, giveaways and games (for example Gel Monsta Fighters) follow the rules shown with them. Prizes and codes earned in a game are for the account that earned them. We may change, pause or end any promotion, and may withhold rewards obtained by cheating, automation or other abuse.
9. Reviews, photos and submissions
When you post a review, send photos, list a salon in our directory, or submit a form, you confirm that the content is yours to share and is accurate, and you give Zillabeau a non-exclusive, royalty-free license to use, display, edit for length and share it on the Site and our social channels. We may decline or remove any content. Do not post anything unlawful, misleading, offensive, or that infringes someone else's rights.
10. Intellectual property
The Site and its content, including text, photos, videos, graphics, logos, Experimon characters and designs, are owned by Zillabeau or our licensors and brand partners and are protected by law. You may not copy, reproduce or use them for commercial purposes without our written permission. Brand names and trademarks of the products we carry belong to their owners.
11. Acceptable use
You agree not to misuse the Site, including by attempting to access accounts or systems you are not authorized to use, interfering with the Site's operation, scraping or harvesting data by automated means, reselling products in violation of brand policies, or using the Site for any unlawful purpose.
12. Third-party links and services
The Site links to and uses services run by others, such as payment providers, shipping carriers, reviews, rewards, chat and social media. We are not responsible for their content or practices; your use of them is subject to their own terms.
13. Disclaimers
Except as stated in our policies or required by law, the Site and products are provided as is and as available, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Product warranties, if any, are provided by the manufacturer or as stated on the product page.
14. Limitation of liability
To the fullest extent allowed by law, Zillabeau and its owners, employees and partners are not liable for indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim related to a purchase is limited to the amount you paid for that purchase.
15. Indemnification
You agree to defend and hold harmless Zillabeau from claims, losses and expenses arising from your breach of these Terms, your misuse of products, or content you submit.
16. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Bergen County, New Jersey, and you consent to their jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. The updated version takes effect when posted on this page, and the date at the top will change. Continued use of the Site after an update means you accept the updated Terms.
